Do we have to go through mediation if we have children and are getting divorced?

From April 2014, it has become a requirement under the Children and Families Act 2014 for a person to attend an initial Family Mediation Information and Assessment Meeting (MIAM) before making certain kinds of applications to obtain a court order.

However, although both parties are expected to attend a MIAM (and any failure to do so could potentially result in the judge halting proceedings and insisting that a mediator is consulted before going any further), it is not compulsory to start the mediation course itself. In addition, if a suitable mediator cannot be found within 15 miles of where the couple live or cannot hold a MIAM within 15 working days, then a MIAM is not required.
